Terms of Service

These Terms of Service ("Terms") govern your access to and use of FOREsight (the "Service"), a tee time alert service for golf courses, operated by Spark Momentum LLC ("FOREsight," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

FOREsight monitors publicly available tee time availability at supported golf courses and notifies you when a tee time matching your chosen criteria becomes available. The Service helps you discover openings. It does not reserve, hold, or book tee times on your behalf. All bookings are completed by you directly through the relevant course or booking platform, subject to that provider's own terms and availability. FOREsight is not responsible for the operation, availability, pricing, policies, transactions, or actions of third-party golf courses or booking platforms.

2. No affiliation

FOREsight is an independent service. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to any golf course, golf management company, or third-party booking platform. All course names and trademarks are the property of their respective owners.

3. Accounts

You must provide accurate information when creating an account and are responsible for activity that occurs under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. Keep your account access secure and notify us promptly of any unauthorized use.

4. Subscriptions and billing

Browsing live tee times is free and does not require a paid subscription. A limited free tier is also available (currently one active single-date alert). Tee Time Alerts beyond the free tier, the full Release Clock, and other premium features require a paid subscription or other access granted by FOREsight.

The FOREsight subscription currently costs $5 per month (USD) and includes a 14-day free trial for eligible new subscribers.

• When you start the free trial, you provide a payment method and authorize FOREsight and its payment processor to automatically charge $5 per month when the 14-day trial ends, unless you cancel before the trial ends.
• After the trial, your subscription automatically renews each month at the then-current price until you cancel. By subscribing, you authorize these recurring charges.
• You may cancel at any time from your account billing settings (which open a secure Stripe billing portal) or by emailing us. Cancellation stops future renewal charges, and you keep access to paid features until the end of your current billing period. Cancellation does not retroactively reverse charges already incurred, except as provided in our Cancellation and Refund Policy (which is part of these Terms) or as required by law.
• Payments are processed by Stripe, Inc. We do not store your full payment card details. Your use of payment features is also subject to Stripe's terms and privacy policy.
• We may change subscription pricing from time to time. If a change applies to your subscription, we will provide advance notice before the new price takes effect, and it will apply only to your future billing periods.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Resell, redistribute, or commercially exploit the Service or its alerts without our written permission.
• Use the Service, its data, alerts, predictions, or other content to build or operate a competing service without our written permission.
• Scrape, harvest, copy, or systematically extract data from the Service except as expressly permitted by us.
• Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its underlying systems.
• Use automated means to access the Service in a manner that places unreasonable load on our infrastructure.

6. Intellectual property

The Service, including its software, design, branding, text, graphics, features, compilations of data, analytics, and proprietary prediction and monitoring features, is owned by or licensed to FOREsight and is protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the Service. Golf course names, logos, trademarks, and other third-party materials remain the property of their respective owners.

7. Service availability and accuracy

We work hard to deliver fast, accurate alerts, but the Service is provided on an "as is" and "as available" basis. Tee time availability changes constantly and is controlled by third parties. We do not guarantee that an alerted tee time will still be available by the time you attempt to book it, that every opening will be detected, or that the Service will be uninterrupted or error-free.

Release Clock predictions, cancellation patterns, confidence indicators, timing windows, and similar insights are estimates based on historical and observed data. They are provided for informational purposes only and do not guarantee that a cancellation or tee time will become available at any particular time.

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, FOREsight disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost bookings, lost opportunities, or lost profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

9. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, your right to use the Service ends. If we discontinue the Service, we will handle any prepaid subscription amounts as required by applicable law and our Cancellation and Refund Policy.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws principles. Subject to applicable law, any legal proceeding arising from these Terms or the Service will be brought in the state or federal courts located in the State of Colorado, and you consent to their jurisdiction.

12. Text message (SMS) alerts

Text alerts are optional and require your consent. Consent to receive text messages is not a condition of purchase; you can use the Service and receive alerts by other methods, such as push notifications. By adding and verifying your mobile number, you agree to receive recurring automated text messages about the tee time alerts you set, plus a one-time verification code. Message frequency varies. Message and data rates may apply. Your carrier is not liable for delayed or undelivered messages. You can opt out at any time by replying STOP to any message; reply HELP for help or contact support@foresightgolfing.com. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We send messages through a third-party SMS provider; how we handle your number is described in our Privacy Policy.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision of these Terms is not a waiver of our right to do so later. These Terms, together with the Privacy Policy and Cancellation and Refund Policy and any other terms expressly incorporated by reference, constitute the entire agreement between you and FOREsight concerning the Service.
